Terms of service
The terms for working together
These terms explain what you get when you buy a website from Main Street Marketing, what we need from you, how our guarantee and monthly plans work, and who owns what. We’ve kept them in plain English. If anything is unclear, ask us before you buy.
“Main Street Marketing,” “we,” “us,” and “our” mean [LEGAL BUSINESS NAME], [STATE] [ENTITY TYPE]. “You” means the person or business buying or using our services. By paying for a website or a monthly plan, you agree to these terms and to our privacy policy.
1. The Storefront website
For $2,500, paid when you sign up, we build one website for your business and host it for its first year. It includes:
- Three complete pages: Home, Services, and Contact. More pages can be added for an extra fee we’ll quote before any work starts.
- Copywriting: we write every page from your onboarding answers.
- Custom design, tested on phones, tablets, and desktops.
- Ways to reach you: a contact form, click-to-call, a map, and links to your booking tools.
- Search- and AI-ready setup: page titles, descriptions, a sitemap, and your business details set up so search engines and AI assistants can understand your site.
- Two rounds of revisions on design and copy (see Revisions).
- Launch: we connect your domain and put your site live.
- 30 days of fixes after launch (see Launch and fixes).
- Your first year of hosting (see Hosting and monthly plans).
Anything not listed here, such as branding, extra pages, Google Business Profile work, local search pages, or review requests, is quoted separately and in writing before we start.
2. Payment
The $2,500 website fee is paid in full, up front, when you sign up. At the same checkout, you start our Hosting plan ($19 a month) with its first year included, and you authorize us to charge the same card $19 a month starting one year after your purchase, until you cancel or change plans. Checkout shows the date of the first monthly charge. Payments are processed by Stripe. Prices are in U.S. dollars and don’t include any sales tax that may apply, which will be added at checkout if required. [Attorney: confirm sales tax treatment of website services in your state.]
3. How a project works
- Onboarding: after you pay, you’ll get a private link to our questionnaire. It collects what we need to build your site. Most people finish in under an hour.
- Timeline: most websites launch about three weeks after your questionnaire is complete. That’s an estimate, not a promise. It depends on how quickly you answer questions, send photos, and review our work.
- What we need from you: accurate information, the photos and files you have, and feedback within [5] business days of each review.
- Pauses: if we don’t hear from you for [60] days, we may pause your project. If it stays paused for [6] months, we may close it, and the website fee won’t be refunded. [Attorney: confirm.]
4. Revisions
Your website includes two rounds of revisions on design and copy. A round is one set of feedback that we then carry out. Further rounds, or changes that go beyond the agreed three pages and scope, are quoted separately before we do them.
5. Our guarantee
Love your first design, or get a full refund.
Your “first design” is the first complete homepage design we present to you, before any revision rounds. If it isn’t right for your business, tell us by email within [7] days of receiving it and we’ll refund the full $2,500. We’ll stop work, and neither of us will owe the other anything further. Any design work we created stays ours and isn’t used for your business.
Once that [7]-day window passes, or once you ask us to continue with revisions, the website fee is non-refundable, except where the law requires otherwise. [Attorney: confirm refund window and wording.]
6. Launch and fixes
We launch your site when you approve it. For 30 days after launch, we’ll fix anything that isn’t working the way we built it, such as a broken link, a form that doesn’t send, or a layout problem on a common device, at no charge. New features, new content, and changes of mind aren’t fixes; those fall under your monthly plan or a separate quote.
7. Hosting and monthly plans
We host the websites we build. Your first year of hosting, counted from the day you pay, is included in the website fee. After that, the Hosting plan continues at $19 a month, or you can move to a plan with more help:
| Plan | Price | Includes |
|---|---|---|
| Hosting | $19/month | Hosting with an SSL certificate, uptime monitoring, daily backups, security and software updates, and up to one change a month |
| Care | $49/month | Everything in Hosting, plus unlimited changes (one request at a time) and a monthly check that forms, links, and pages work |
| Growth | $249/month | Everything in Care, plus two new pages or articles a month, topics planned around what your customers search for, and a quarterly review |
- Month to month: plans renew automatically each month until you cancel. You can upgrade, downgrade, or cancel anytime by emailing us, effective at the end of the current billing month. We don’t give partial-month refunds.
- Unused changes don’t roll over to the next month.
- Before your first monthly charge: we’ll email you a reminder at least [7] days ahead. If you cancel before then, you won’t be charged. We’ll give you a copy of your website’s files and [30] days’ notice before we stop hosting it. [Attorney: confirm reminder timing and cancellation steps meet automatic-renewal laws in your state and your clients’ states.]
- Price changes: we’ll give you at least 30 days’ notice by email before any plan price changes.
- Late payment: if a monthly payment fails and isn’t resolved within [14] days of our notice, we may pause changes or take the site offline until it’s paid. [Attorney: confirm.]
8. What counts as a change
A change is one request to update what’s already on your site: text, photos, hours, services, prices, links, or a small layout tweak. We handle one request at a time and aim to finish most within two business days. New pages, new features, and redesigns aren’t changes; we’ll quote them separately first.
9. Who owns what
- Your website: once you’ve paid in full, you own the text we write for you and the final design of your pages.
- Things we license, not own: fonts, stock photos, icons, software, and hosting are provided by others under their own licenses. You can keep using them on your site as long as it runs with us. If you move your site elsewhere, some may need their own license.
- Our tools: the methods, templates, and code we reuse across clients stay ours. You may use them as part of your website.
- Our portfolio: we may show your finished website and describe our work on it in our marketing. Tell us if you’d rather we didn’t.
10. Your content
You keep ownership of everything you give us: your logo, photos, testimonials, and information. You give us permission to use it to build, host, and maintain your website. You confirm that you have the right to share it, including permission from anyone who appears in photos or testimonials, and that it doesn’t break any law or anyone else’s rights.
11. Domains and other services
Your domain (your web address) stays in your name, and you pay its registration fees directly. Tools your site connects to, such as booking systems, email marketing, or payment services, are provided by other companies under their own terms and fees. We’re not responsible for their outages or changes, though we’ll help where we can.
12. What we can’t promise
We build sites that search engines and AI assistants can understand, but no one can guarantee search rankings, AI recommendations, traffic, leads, or sales. We work to keep your site online, but we can’t promise it will never be unavailable, for example during an outage at our hosting provider.
13. Limits of our responsibility
We provide our services with care and skill, but otherwise “as is.” To the extent the law allows, we aren’t responsible for indirect or consequential losses, such as lost profits or lost data, and our total responsibility for any claim is limited to the amount you paid us in the 12 months before the claim. [Attorney: review and adjust for your state.]
14. Ending our work together
Either of us can end a project by email. If you end it before your first design is presented, [we’ll refund the website fee minus [$___] for work already done]. After that, refunds follow Our guarantee. If you leave while we host your site, we’ll give you a copy of your website’s files.
15. The legal basics
These terms are governed by the laws of the State of [STATE]. Any dispute will be handled in the state or federal courts located in [COUNTY], [STATE]. [Attorney: consider informal resolution or mediation first.] If part of these terms can’t be enforced, the rest still applies. We may update these terms; the version in effect when you buy applies to that purchase, and we’ll email current clients about significant changes to monthly plans.
